APPLIED JURISPRUDENCE IN LEGAL WORK – IMPLICATIONS FOR RESEARCH, ADVICE AND CRITIQUE IN CORPROATE, COMMERCIAL AND BUSINESS LAW
speaker: professor bryan horrigan
This seminar will explore a wide range of applications for applied jurisprudence in a variety of areas of business, corporate, and commercial law. It will challenge you to think about the levels of legal theorising necessary for legal problem-solving and policy consideration in these areas of law and regulation, illustrated by reference to contemporary High Court decisions and other topical developments, including topics as diverse as unfair business conduct, corporate social responsibility and governance, and the intermingling of common law, equity, and legislation in enhanced legal protection for consumers and small business.
Professor Bryan Horrigan is a newly appointed professor in law at Macquarie University, where he is also the new Associate Dean (Research) for the Division of Law. After completing undergraduate degrees in law and arts at the University of Queensland, he completed a thesis based on legal reasoning and the High Court of Australia for his doctorate in law under a Rhodes Scholarship at Oxford University, where his supervisor was Professor John Finnis (author of Natural Law and Natural Rights). He has worked in legal practice for a national commercial law firm as both a senior associate and now a consultant, and he is the immediate past Director of the National Centre for Corporate Law and Policy Research in Canberra. His latest book, Adventures in Law and Justice: Exploring Big Legal Questions in Everyday Life (UNSW Press, 2003), explores a range of topical and timeless jurisprudential questions in their application to contemporary law and life. His published research has also been cited in High Court judgments and speeches, law reform documents, and the published research of other academics. His opinions on topical legal issues have also been published in every major national Australian newspaper, and he appears currently as a regular radio guest commentator on legal affairs on James O'Loghlin's 'Evening Show' on ABC Radio.
